Most battery energy storage system (BESS) projects don’t start with a permitting consultant on the team. And honestly, not all of them need one. But that’s not what most projects look like in 2026.
What most projects look like is this: a promising site with ambiguous zoning, a county that has never seen a BESS application, neighbors who’ve read about the Moss Landing fire, an interconnection queue that’s three years deep, and a tax credit eligibility window that closes if construction doesn’t begin by a specific date. That’s the project where a permitting consultant earns their fee in the first month.

So they either default to the most conservative interpretation available or they freeze the process entirely and enact a moratorium while they figure it out.
As of mid-2026, over 150 jurisdictions across 17 states have active moratoriums or restrictions on BESS development. If your permitting timeline slips by a year, you don’t just lose time. You may face a higher MACR threshold that changes your entire procurement strategy. A project that passes at 55% with a particular battery supplier might fail at 60% with the same supplier. The permitting delay doesn’t just cost you months — it costs you equipment options, financing terms, and potentially the tax credit itself.
