Zoning determines where a battery energy storage system (BESS) can be built before any other permit is filed. Local zoning ordinances classify land into districts — residential, commercial, industrial, agricultural — and each district has its own rules about what can be constructed there. For utility-scale energy storage projects, navigating these zoning classifications is one of the first and most consequential steps in the development process, as outlined in the BESS permitting guide.
Most developers encounter BESS zoning for the first time when they discover that battery storage doesn’t fit neatly into existing land-use categories. Unlike solar farms or wind turbines, which many jurisdictions now address with dedicated ordinances, grid-scale battery storage often falls into a regulatory gray zone.
Utility-scale BESS projects are most commonly permitted in industrial zones, where heavier infrastructure is already expected. Some jurisdictions also allow battery storage in agricultural or commercial districts, especially when co-located with solar generation or an existing electrical substation.
The key distinction is whether BESS is permitted “by right” in a given zone or requires a discretionary approval. In Fairfax County, Virginia, for example, a 2026 zoning amendment classified large-scale BESS as a “light utility facility” — permitted by right in some industrial districts but requiring a special exception in others. Will County, Illinois, permits BESS in one agricultural district and three industrial districts, with system size determining the approval pathway.
Where no BESS-specific ordinance exists, developers typically need a zoning variance or amendment — a longer process that involves public hearings and planning commission review.
Setbacks define the minimum distance a BESS installation must maintain from property lines, roads, and adjacent structures. These distances directly affect how much of a site is usable for battery containers, inverters, and switchgear.
BESS-specific setback distances vary widely. Fairfax County requires a 200-foot minimum setback from residential lot lines. The American Clean Power Association’s model ordinance references NFPA 855 separation distances, which are calculated based on system size, energy capacity, and surrounding environment. In practice, most jurisdictions that set BESS-specific setbacks use distances of 50 to 200 feet from property lines.
Beyond property-line setbacks, some ordinances require vegetative buffers, screening fences, or visual impact mitigation — particularly when a BESS site is near residential areas. Noise setbacks may apply separately, since inverters and cooling systems generate continuous low-frequency sound.
When BESS is not permitted by right in a zoning district, developers typically need a special use permit (SUP) or conditional use permit (CUP). These discretionary approvals require the developer to demonstrate that the project is compatible with the surrounding area and meets specific conditions.
The SUP/CUP process usually involves submitting a site plan, conducting environmental and safety studies, and presenting the project at a public hearing before the local planning board. Required studies commonly include an environmental site assessment, noise study, visual impact assessment, traffic study, and fire and explosion risk assessment.
This process adds 3 to 12 months to the development timeline depending on the jurisdiction. In areas with active opposition to energy infrastructure, timelines can extend further as projects face multiple hearing cycles.
Because many zoning boards are encountering BESS projects for the first time, developers who invest in early education and engagement tend to move faster through the approval process. This starts with understanding whether the jurisdiction has existing BESS ordinances, relevant model ordinances it may adopt, or precedent from similar energy projects.
Pre-application meetings with planning staff — before formal submission — can surface potential concerns early and allow the developer to address them proactively. Common board concerns include fire safety, noise, visual impact, property values, and decommissioning. Providing clear, factual responses to each concern, backed by third-party studies, is more effective than treating the hearing as a formality.
In jurisdictions where zoning prohibits BESS outright, developers may pursue a zoning text amendment or explore state-level bypass pathways in states that have them. Seven states currently have active laws allowing developers to bypass local restrictions through state permitting processes.
